Terms of Use
In short: you may play DEADGRIND on your own devices for private fun. The online leaderboard is optional: before you use it the game asks you to accept these terms and the Community Rules, and you can withdraw and delete your heroes from it at any time. Keep hero names clean: offensive names are removed, and installs that break the rules can be blocked. Purchases are handled by Google Play or the App Store. German law applies, and your mandatory consumer rights always stay.
1. The game and these terms
DEADGRIND (the "Game") is a game for Android and iOS devices, distributed through Google Play and the Apple App Store. It is published by Demonfork, owner Leon Klostermann, Aachen, Germany ("we", "us"). The full postal address is in our Impressum.
These Terms of Use are the end-user licence agreement (EULA) for the Game and for its online services, currently the online leaderboard (together the "Service"). How we handle data is described in our Privacy Policy.
2. Acceptance
- By installing or using the Game you agree to these terms. If you do not agree, do not install or use the Game.
- Before you use the online leaderboard for the first time, the Game shows the Community Rules (section 7) and asks you to accept them together with these terms (I AGREE). If you decline, the leaderboard stays closed; the rest of the Game works as before. When we change these terms in a way that matters for the online features, the Game asks you again before you can use them.
3. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Game on devices that you own or control, for private, non-commercial entertainment. The Game is licensed to you, not sold.
4. What you must not do
- copy, modify, translate, reverse-engineer, decompile or disassemble the Game, except where mandatory law allows it;
- distribute, sublicense, rent, lend or otherwise make the Game available to third parties;
- bypass or disable security, copy protection or other technical measures of the Game or the Service;
- use cheats, bots, modified game files, manipulated save files or modified versions of the Game, in particular to change the progress or gear that is shown on the leaderboard;
- attack, overload or automatically read out our servers beyond the normal use of the Game;
- use the Game or the Service for commercial purposes or for anything unlawful.
5. Purchases
- The Game is free to play and fully playable without paying. It offers optional in-app purchases: the tier packs (AD-FREE, PLUS and SUPPORTER), more space (bag expansions and stash tabs), one limited-time offer, and reliquaries. The tier packs, bag expansions and stash tabs are one-time purchases that you can restore on a new device with the same store account.
- Reliquaries are sealed boxes with random swords. Before you buy one, the Game shows its possible contents, their odds and the power range of the swords. A bought reliquary is used up when you open it. Where paid random items are not allowed (for example in Belgium), reliquaries cannot be bought.
- Purchases are billed by Google Play or Apple to your store account at the price shown in the store. The store's terms and refund rules apply. We never see your payment details.
- Virtual goods have no real-world monetary value, cannot be exchanged for money and cannot be transferred to other accounts. Consumable goods are used up when you use them. We may balance or change how virtual goods work in the Game.
- Right of withdrawal (EU): your statutory right of withdrawal and the store's refund rules apply. For digital content that is delivered at once, the store explains at the purchase when the right of withdrawal ends.
6. Advertising
The Game shows no forced ads. Where it offers a small bonus for watching an ad, watching is your choice; these rewarded ads are served by Google AdMob under your consent choices. The tier packs let you claim those bonuses without an ad. Details are in the Privacy Policy.
7. Community Rules: hero names and online content
The names you give your heroes are shown to every player on the online leaderboard when you choose to show your heroes there. DEADGRIND has zero tolerance for objectionable content and abusive players.
- Not allowed in hero names: hate speech, discrimination, harassment, threats, sexual content, glorification of violence against real people, impersonation of other people, of us or of brands, personal data (for example real names of others, phone numbers or addresses), advertising, links and anything else that is unlawful or infringes the rights of others.
- You are responsible for the names you choose. You confirm that you have the right to use them.
- You allow us, free of charge and worldwide, to store and show your hero names and the hero details described in the Privacy Policy on the leaderboard and in the Game, for as long as they are on the leaderboard.
8. Reporting, hiding and moderation
- Names pass an automatic word filter when they are sent; a hero whose name it rejects is not listed.
- You can report a name (REPORT NAME in a hero's profile) and hide a player on your device (HIDE PLAYER). Hidden players come back with SHOW HIDDEN PLAYERS AGAIN under Settings > GAME.
- We check reports by hand. We may hide or delete entries that break these terms, hide entries with implausible progress until we have checked them, and block an install that breaks these terms seriously or repeatedly, so that its heroes are no longer listed.
- You can also report content to us by email: support@demonfork.io.
9. The online leaderboard
- The leaderboard ranks the heroes of all players who chose to show theirs, by their progress in the Game. Showing your heroes is optional: the Game sends nothing about your heroes until you choose SHOW MY HEROES or turn on "Show my heroes on the leaderboard" under Settings > GAME.
- You can withdraw at any time under Settings > GAME: turn off "Show my heroes on the leaderboard" or tap DELETE MY LEADERBOARD DATA. Your heroes are then deleted from our server.
- A place on the leaderboard gives no claim to a rank, a prize or a reward.
10. Availability and updates
We provide the online services as they are and as far as they are available. They may be interrupted for maintenance or technical reasons, and we may change, limit or end them in the future; where reasonable, we announce this in advance. The Game itself stays playable without them. We may update the Game; some updates may be needed to keep using the online services.
11. Termination
You can stop using the Game at any time by uninstalling it; your leaderboard data can be deleted as described in section 9. We may block your access to the online services if you break these terms seriously or repeatedly. The licence ends if you break it seriously. Sections 12, 13 and 15 continue to apply after the licence ends.
12. Ownership
All rights in the Game, including its code, art, music, sounds and texts, belong to us or our licensors. Third-party software and assets in the Game are used under their licences, listed in the Game under Settings > GAME > CREDITS.
13. Warranty and liability
- Your statutory rights in case of defects apply.
- We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and under any guarantee we have given.
- For slight negligence we are only liable for breaches of essential obligations, that is obligations whose fulfilment makes the proper use of the Game possible in the first place and on which you may regularly rely, limited to the foreseeable damage typical for this kind of contract.
- Beyond that, our liability is excluded. These limits also apply to our representatives and assistants.
14. Google Play and the Apple App Store
Google and Apple are not parties to these terms. If you got the Game from Google Play, the Google Play Terms of Service also apply to the download and to purchases. If you got the Game from the Apple App Store:
- these terms are between you and us, not Apple, and we, not Apple, are solely responsible for the Game and its content;
- the licence in section 3 lets you use the Game on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions;
- Apple has no obligation to provide maintenance or support for the Game;
- if the Game fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Game (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Game;
- we, not Apple, are responsible for addressing any claims relating to the Game or your use of it, including product liability claims, claims that the Game fails to conform to legal or regulatory requirements, claims under consumer protection or privacy law, and claims that the Game infringes the intellectual property rights of a third party;
- you confirm that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties;
- you must comply with applicable third-party terms (for example your mobile data contract) when you use the Game;
- Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, have the right to enforce them against you as a third-party beneficiary.
15. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country where you have your habitual residence remain unaffected.
16. Changes to these terms
We may change these terms for valid reasons, for example new features, changes in the law or to prevent abuse. The current version and its date are shown at the top of this page. When a change matters for the online features, the Game asks you to accept the new version before you use them again; if you do not accept it, the online features stay closed and the rest of the Game works as before.
17. Severability
If any of these terms is invalid or unenforceable, the others remain valid.
